Terms of Service

These Terms of Service (“Terms”) govern your use of the FirstEcho web application and related services (the “Service”) operated by FirstEcho (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to create an account and use the Service. By using FirstEcho, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. The Service is designed for parents and caregivers to use with their children — it is not intended for use by minors.

2. Service Description

FirstEcho is a web application that teaches parents baby sign language through Montessori-aligned video modules. The Service includes free and premium content tiers, AI-powered practice feedback, progress tracking, and care team collaboration features.

3. Accounts

  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate information when creating your account and keep it up to date.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Free & Premium Access

  • Free tier: Access to Module 1 (Basic Needs) and limited sign library browsing.
  • Premium: Full access to all modules, progress tracking, AI practice mode, video features, and care team collaboration. Billed monthly or as a lifetime purchase.
  • Subscriptions are processed through Stripe and can be managed through your account settings.
  • Prices are displayed in your local currency where available and include applicable taxes unless stated otherwise.

5. Cancellation & Refunds

  • You can cancel your subscription at any time from your account settings. Access continues until the end of your current billing period.
  • For monthly subscriptions, no refunds are provided for partial billing periods.
  • For lifetime purchases, refunds are available within 14 days of purchase if you have not accessed premium content beyond Module 1.
  • EU consumers have a 14-day right of withdrawal from the date of purchase. By accessing premium content, you acknowledge that the withdrawal right is waived once the digital content has been fully provided.

6. User Content

Videos and photos you upload remain your property. By uploading content, you grant FirstEcho a limited, non-exclusive license to store, process, and display it within the Service according to your sharing preferences. This license terminates when you delete the content or your account. You may delete your content at any time.

You represent that you have the right to upload any content you submit and that it does not violate any third party's rights.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Upload content that is harmful, offensive, or violates the rights of others.
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems.
  • Reverse-engineer, decompile, or otherwise attempt to extract the source code of the Service.
  • Use automated means (bots, scrapers) to access the Service without our written permission.

8. Intellectual Property

All content provided through the Service — including sign language videos, instructional text, illustrations, and software — is owned by FirstEcho or its licensors and is protected by copyright and other intellectual property laws. You may not copy, distribute, or create derivative works from our content without written permission.

9. Medical Disclaimer

FirstEcho is an educational tool. Our content, including AI-powered practice feedback, is not a substitute for professional medical, developmental, or therapeutic advice. If you have concerns about your child's development, consult a qualified healthcare provider. We make no claims that using sign language will achieve specific developmental outcomes.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by applicable law, FirstEcho and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims arising from or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

Nothing in these Terms limits liability for (a) death or personal injury caused by negligence, (b) fraud, or (c) any liability that cannot be excluded or limited under applicable law, including mandatory EU consumer protection rights.

12. Account Deletion

You can delete your account and all associated data from your profile settings at any time. Deletion is permanent, takes effect within 30 days, and cannot be reversed. See our Privacy Policy for data retention details.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, with the arbitration conducted in English.

If you are an EU consumer, nothing in this section limits your right to bring proceedings in the courts of your country of residence or to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
